The Eighth Amendment applies. If he is subject to cruel and unusual punishment, he has the right to have those conditions corrected. That does NOT entitle him to release.

He's a terrorist who was caught in the act of trying to murder scores of people. Execute him. Why are we even paying to keep this guy alive? Unless he is in solitary, he's probably spewing his hatred of everything non-sharia to all the other inmates, possibly manipulating their minds as well.

Because of the Obummer DOJ rule of trying Terrorist in Civilian courts and not Military courts. That's why he's not in Gitmo or on Death Row.
