Yes, it's a crime in the US Code.  If you're a federal prosecutor, that's the definition you would use.  If you're anyone else, you're free to use other definitions of "insurrection" and "crime" that may be less formal.

So, let me just see if I understand this... they got a guy for possession of a firearm on federal property, but he didn't go into the Capitol building, and they didn't actually see him with it. He said some mean things, too. On the strength of his son's testimony, they are talking about putting him behind bars for 15 years. You're supporting people who are doing the Lord's work, Mikey. We're really focusing on the important stuff here.
