Legislatures can pass whatever laws they want about who can sue and for what.  Individuals can sign contracts and waivers for anything. Judges are free to "interpret" those laws and contracts and waivers however they see fit.  The law was unconstitutional. The contract was unenforceable.  The waiver was signed without sufficient information. Etc. Sympathetic cases can give surprising results.
